These Terms of Service ("Terms") govern your access to and use of the KULL 1 platform, including our website, mobile application, and all associated services (collectively, the "Platform"), operated by KULL 1 ("we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms.
You must be at least 18 years old to create an account or register as a Tournament Director. Anglers under 18 may participate in tournaments with parental consent and supervision. By using the Platform, you represent that you meet these requirements.
To participate in tournaments, you must create an account with accurate information. You are responsible for maintaining the security of your account and all activity that occurs under it. Sharing accounts between multiple anglers is prohibited and may result in disqualification.
Each catch submission must represent a fish caught by the registered angler during the active tournament window. Submitting false catches, manipulating GPS coordinates, or using photographs from other sources constitutes cheating and will result in immediate account termination and forfeiture of any prizes.
Tournament Directors must complete the club enrollment process, including identity verification and banking setup, before creating paid tournaments. By completing enrollment, you certify that all information provided is accurate and that you have authority to bind your organization to these Terms.
Tournament Directors are responsible for:
KULL 1 charges a platform fee of $5.00 per angler entry for paid tournaments and $3.50 per active subscription, collected at the point of payment. These fees are deducted automatically at transaction time. Entry fee proceeds (net of platform fees) are disbursed to the Tournament Director's registered bank account within 2 business days after tournament close.
All fees are non-refundable except where required by law. Entry fee refunds to anglers are at the Tournament Director's discretion and subject to their stated refund policy.
All catches are subject to verification by Tournament Directors. KULL 1 provides tools to assist in verification but does not independently adjudicate catch disputes. Tournament Director decisions on catch eligibility are final within the tournament. KULL 1 reserves the right to investigate and void results in cases of suspected fraud or platform manipulation.
GPS verification is required for all catch submissions. Catches submitted from non-water locations (as determined by GPS coordinates) will be automatically flagged and may be disqualified.

Violations may result in account suspension, permanent bans, forfeiture of prizes, and legal action where appropriate.
Tournament results, catch records, standings, and leaderboard data are public records on the Platform. By submitting a catch, you grant KULL 1 a non-exclusive, worldwide license to display your name, catch data, photographs, and results on the Platform and in marketing materials. You retain ownership of photographs you submit.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. KULL 1 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING LOSS OF TOURNAMENT PRIZES OR ENTRY FEES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO KULL 1 IN THE 12 MONTHS PRECEDING THE CLAIM.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may update these Terms from time to time. When we make material changes, we will notify you via email and/or a prominent notice on the Platform. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
